These Terms and Conditions (“Terms”) govern the sale and use of ECU tuning files, remapping software, and related digital products and services (“Products”) supplied by Automight LLC (“we”, “us”, “our”, “the Company”) through the website smartroadster.tech (“the Website”). By purchasing, downloading, or using any Product, you (“the Customer”, “you”, “the end user”) agree to be bound by these Terms in full. If you do not agree, do not purchase or use our Products.
1. Nature of the Products
1.1. The Products are digital tuning files intended to modify the engine control unit (ECU) software of a motor vehicle, specifically the Smart Roadster 452 equipped with the Bosch MEG 1.1 ECU.
1.2. The Products are performance modification files. They alter factory parameters including but not limited to turbo boost pressure, ignition timing, lambda/air-fuel ratio, torque limiters, rev limiters, and other engine management values.
1.3. Modifying a vehicle’s ECU is an inherently risky activity that can affect the reliability, longevity, emissions, roadworthiness, and legal status of the vehicle. You acknowledge that you understand and accept these risks in full before purchase.
1.4. The Products are supplied as digital files only. We do not perform any physical work on your vehicle, do not install the files, and are not present during installation.
2. No Inspection, No Diagnosis, No Warranty of Fitness
2.1. We cannot and do not inspect, examine, test, or diagnose your vehicle. We have no knowledge of the mechanical condition, service history, prior modifications, wear, damage, or any pre-existing faults of your specific vehicle.
2.2. The suitability of any Product for your specific vehicle depends entirely on factors that are exclusively within your knowledge and control, including but not limited to: the mechanical condition of the engine, turbocharger, clutch, gearbox, cooling system, fuelling system, and all related components; the quality and octane of fuel used; the standard of installation; and adherence to our guidance.
2.3. Because we cannot diagnose your vehicle remotely, you are solely responsible for determining whether your vehicle is in a suitable condition to receive an ECU modification. We strongly recommend a full mechanical inspection by a qualified professional before any modification.
2.4. The Products are supplied “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, or fitness for a particular purpose, to the fullest extent permitted by law.
3. Assumption of Risk and Limitation of Liability
3.1. You acknowledge and agree that you install and use the Products entirely at your own risk. As the end user, you are the only party able to assess the condition of your vehicle and the only party performing or commissioning the installation. Accordingly, you accept that you are solely and exclusively responsible for any and all consequences arising from the purchase, download, installation, or use of the Products.
3.2. To the fullest extent permitted by applicable law, Automight LLC shall not be liable for any damage, loss, cost, or expense of any kind arising directly or indirectly from the use, misuse, installation, or presence of the Products, including but not limited to:
- (a) mechanical damage to the engine, turbocharger, clutch, gearbox, transmission, cooling system, fuelling system, catalytic converter, or any other vehicle component;
- (b) engine failure, component failure, overheating, detonation, pre-ignition, or bearing failure;
- (c) clutch slip, clutch wear, or clutch failure resulting from increased torque;
- (d) a bricked, corrupted, or non-functional ECU resulting from an interrupted, incorrect, or incompatible flashing procedure;
- (e) loss of manufacturer warranty, insurance coverage, or vehicle value;
- (f) failure to pass roadworthiness, emissions, or technical inspection;
- (g) fines, penalties, or legal consequences arising from non-compliant vehicle use;
- (h) consequential, incidental, indirect, special, or punitive damages;
- (i) loss of use of the vehicle, loss of profit, or loss of time;
- (j) any personal injury or death resulting from mechanical failure or altered vehicle behaviour, to the fullest extent permitted by law;
- (k) damage caused during the physical flashing process, including damage caused by cables, interfaces, dead batteries, or power interruptions.
3.3. The clutch warning is expressly acknowledged: you understand that higher-torque maps (particularly the Evolution level) can and likely will damage a standard or worn clutch, and that an uprated clutch rated to at least 250 Nm is required. Proceeding without one is entirely at your own risk.
3.4. Where liability cannot be excluded by law, our total aggregate liability to you for any claim shall not exceed the amount you actually paid for the specific Product giving rise to the claim.
3.5. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our proven negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law.
4. Customer Responsibilities and Warranties
4.1. You warrant that:
- (a) you are at least 18 years of age and have full legal capacity to enter into these Terms;
- (b) you are the owner of the vehicle or are duly authorised by the owner to modify it;
- (c) you have verified that your ECU is genuinely a compatible Bosch MEG 1.1 with a compatible ECU ID before flashing;
- (d) you have read and understood all guidance, warnings, and instructions provided;
- (e) you possess, or have engaged a professional who possesses, the necessary skill, tools, and knowledge to flash the ECU correctly;
- (f) you will always create and retain a backup (read) of the original ECU file before writing any modified file;
- (g) you will not use the Product on any vehicle other than the one for which it was supplied.
4.2. You are responsible for compliance with all laws applicable in your country and jurisdiction regarding vehicle modification, emissions, road use, insurance, and type approval. ECU modifications may be illegal for road use in your jurisdiction. It is your responsibility to verify this. The Products may be intended for off-road, track, or motorsport use only where required by local law.
4.3. You are responsible for ensuring correct installation, correct file selection, and correct flashing procedure. A significant proportion of ECU damage results from installation error, incompatible hardware, or an interrupted flash — none of which are within our control.
5. Intellectual Property
5.1. All Products, files, guides, and content remain the intellectual property of Automight LLC. You are granted a non-transferable, non-exclusive licence to use the purchased file on a single vehicle for your own use.
5.2. You may not resell, redistribute, share, copy, reverse-engineer, or commercially exploit the Products or any part of them. Doing so constitutes a material breach and may result in legal action.
6. Digital Delivery
6.1. The Products are delivered digitally and immediately upon successful payment, via download.
6.2. You acknowledge that, because delivery is immediate, specific provisions regarding the right of withdrawal apply — see our Refund Policy.
7. No Professional Advice
7.1. Information provided on the Website, in articles, and in guides is for general informational purposes only and does not constitute professional mechanical, legal, or engineering advice. You should not rely on it as a substitute for professional inspection and advice specific to your vehicle.
8. Indemnity
8.1. You agree to indemnify and hold harmless Automight LLC, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or connected with your purchase, installation, or use of the Products, your breach of these Terms, or your violation of any law or third-party right.
9. Governing Law and Jurisdiction
9.1. These Terms are governed by the laws of Malta. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malta, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
10. Amendments and Severability
10.1. We may update these Terms at any time. The version in force at the time of your purchase applies to that purchase.
10.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
